Terms of Service
Article 1. Purpose
These Terms of Service ("Terms") govern the use of the Luna Whale Art Lab platform ("Service"), operated by Luna Whale Inc. ("Company"). By accessing or using the Service, you agree to be bound by these Terms. The Service provides online and offline art education content, curriculum management tools, and community features for art educators, academy owners, and individual learners.
Article 2. Definitions
- "Member" refers to any individual or entity that has agreed to these Terms and registered an account with the Service.
- "Content" includes all curriculum materials, lesson plans, reference artworks, instructional videos, templates, and educational resources provided through the Service.
- "User Content" refers to artwork, images, comments, and other materials uploaded or submitted by Members.
- "Subscription" means a paid or free membership plan that grants access to specific tiers of Content.
Article 3. Membership & Registration
Membership is established when a user completes the registration process and the Company approves the application. Members must provide accurate and current information. The Company may refuse or revoke membership if false information is provided, if the applicant has previously violated these Terms, or if approval would otherwise be technically or commercially impractical.
Article 4. Services Provided
The Company provides the following services:
- Art education curriculum for children, teens, and adults (Monthly, Special, Masterpiece classes)
- Downloadable lesson plans, reference images, and instructional guides for art academy operators
- Student portfolio management and artwork gallery features
- Class creation and scheduling tools for educators
- Community features including comments, sharing, and collaborative projects
Article 5. Subscription Plans & Payment
The Service offers free (Basic) and paid (Standard, Premium) subscription tiers. Paid subscriptions are billed monthly or annually as selected at the time of purchase. Prices are displayed on the Membership page and may be adjusted with 30 days prior notice. All payments are processed securely through our authorized payment partners. Subscriptions automatically renew unless cancelled before the renewal date.
Article 6. Cancellation & Refunds
- Members may cancel their subscription at any time from the Settings page. Access continues until the end of the current billing period.
- Refunds for individual lesson purchases are available within 7 days of purchase, provided the content has not been downloaded or accessed.
- Annual subscriptions may be refunded on a pro-rata basis within the first 14 days, minus any content already accessed.
- Refund requests should be submitted through the Help & Support page or by emailing support@lunawhale.com.
Article 7. Intellectual Property & Copyright
- All Content provided through the Service, including but not limited to lesson plans, reference artwork, instructional videos, and curriculum designs, is the intellectual property of Luna Whale Inc. and is protected under applicable copyright laws.
- Premium subscribers are granted a non-exclusive, non-transferable license to use Content for in-person educational purposes at their licensed facility (e.g., art academy, school, studio).
- Commercial redistribution, resale, or unauthorized sharing of digital Content files is strictly prohibited.
- Members retain ownership of their User Content (original artworks, photos). By uploading User Content, Members grant the Company a non-exclusive, royalty-free license to display it within the Service (e.g., Gallery, community features).
Article 8. Member Obligations
Members shall not engage in the following activities:
- Sharing account credentials with unauthorized individuals
- Redistributing, copying, or commercially exploiting Content without authorization
- Uploading content that infringes on third-party intellectual property rights
- Using the Service for any unlawful purpose or to harm other Members
- Attempting to circumvent security measures, access restrictions, or payment systems
Article 9. Service Modifications & Interruptions
The Company may temporarily suspend the Service for maintenance, system upgrades, or force majeure events. The Company will provide reasonable notice of planned interruptions when possible. The Company reserves the right to modify, add, or discontinue specific features or content with prior notice.
Article 10. Limitation of Liability
The Company shall not be liable for damages arising from: (a) service interruptions caused by circumstances beyond reasonable control; (b) loss of data due to Member negligence; (c) disputes between Members; or (d) the accuracy or completeness of educational content, which is provided for instructional purposes only. The total liability of the Company shall not exceed the fees paid by the Member during the 12 months preceding the claim.
Article 11. Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea. Any disputes arising from these Terms shall be resolved in the competent court of Seoul, Republic of Korea. Before initiating legal proceedings, both parties agree to attempt resolution through good-faith negotiation.
Article 12. Miscellaneous
- The Company may update these Terms at any time. Significant changes will be communicated at least 7 days in advance via in-app announcement or email.
- If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
- For matters not covered by these Terms, applicable laws and customary practices shall apply.
